These Terms of Service ("Terms") govern your access to and use of www.leewayfitness.in and any related sub-domains, mobile applications, services, and storefronts (collectively, the "Website") operated by Lavanya Teleservices Private Limited ("Leeway", "we", "us", or "our"), a company incorporated under the Companies Act, 2013.

These Terms form a binding electronic agreement between you and Leeway under the Information Technology Act, 2000, the Indian Contract Act, 1872, and the Consumer Protection Act, 2019, read with the Consumer Protection (E-Commerce) Rules, 2020. No physical or digital signature is required to make these Terms enforceable.

By using the Website, creating an account, or placing an order, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, and our Refund & Returns Policy. If you do not agree, please do not use the Website.

Eligibility

By using this Website, you represent and warrant that:

  • You are at least 18 years of age and competent to enter into a binding contract under Indian law.
  • You are not a person barred from receiving services under the laws of India or any other applicable jurisdiction.
  • All information you provide (name, contact details, address, payment details) is true, accurate, current, and complete.
  • If you are using the Website on behalf of a business or organization, you have the authority to bind that entity to these Terms.

Minors under 18 may use the Website only under the supervision of a parent or legal guardian who agrees to these Terms on their behalf.

Account Registration

You may browse the Website without creating an account, but certain features, such as order tracking, saved addresses, wishlists, and faster checkout, require registration.

By creating an account, you agree to:

Medical & Fitness Risk Disclaimer

This section is important. Please read carefully before purchasing or using any Leeway product.

Fitness equipment and physical exercise carry inherent risks, including but not limited to muscle strain, joint injury, cardiac events, falls, and equipment-related accidents.

  • Consult your physician before beginning any exercise program, especially if you have any pre-existing medical condition, are pregnant, are recovering from injury or surgery, or have not exercised regularly.
  • Read all product manuals, weight ratings, and safety instructions before assembly and use. Do not exceed the maximum user weight or load capacity specified for each product.
  • Use Leeway products only for their intended purpose, in a safe environment, on suitable flooring, and with appropriate safety gear (gloves, shoes, spotters where required).
  • Supervise children and untrained users at all times. Many products are not suitable for children.
  • Leeway products marketed for home use are not warranted for commercial or institutional use (gyms, hotels, schools) unless explicitly described as commercial-grade.

You assume all risks associated with the assembly, installation, and use of Leeway products. To the maximum extent permitted by law, Leeway shall not be liable for any injury, illness, death, or property damage arising from the use, misuse, or assembly of its Products. This disclaimer is in addition to, and not in place of, the limitations of liability set out in Section 17.

Acceptable Use

You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, the Website by any third party.

You must NOT:

  • Use the Website for any fraudulent, illegal, or unauthorized purpose.
  • Attempt to gain unauthorised access to any portion of the Website, accounts, servers, or networks.
  • Copy, reproduce, scrape, mirror, frame, or redistribute any Content without our prior written permission.
  • Upload or transmit viruses, malware, worms, trojans, or any other malicious code.
  • Use bots, crawlers, automated scripts, or data-mining tools to access the Website (except well-behaved search engine crawlers).

  • Resell Leeway Products at unauthorized marketplaces or in violation of any applicable channel partner agreement.

Violation of this section may result in immediate account suspension, order cancellation, legal action, and reporting to law enforcement under the Information Technology Act, 2000, and the Indian Penal Code.

Product Information & Pricing

We make reasonable efforts to ensure that product descriptions, specifications, images, colors, and pricing on the Website are accurate. However:

  • Colors may vary slightly across devices and screens.
  • Minor specification variations may occur between production batches (weight tolerance, finish, packaging).
  • Prices, offers, and availability are subject to change without prior notice.
  • Typographical, photographic, or pricing errors may occasionally appear. We reserve the right to correct any error and to cancel or refuse any order placed at an incorrectly listed price or based on an erroneous description, even after order confirmation. In such cases, any amount already charged will be refunded in full.

All prices are listed in Indian Rupees (INR/₹) and are inclusive of applicable GST, unless stated otherwise. Shipping and handling charges, where applicable, will be shown at checkout.

Orders, Payments & Taxes

Order Acceptance

Placing an order on the Website constitutes an offer to purchase, which Leeway may accept or decline at its sole discretion. An order is deemed accepted only upon dispatch confirmation. Until then, no contract of sale exists.

We may decline, cancel, or limit any order for reasons including but not limited to:

  • Stock unavailability
  • Inaccurate pricing or product information
  • Suspected fraud, payment failure, or chargeback risk
  • Failure to comply with these Terms
  • Bulk or wholesale orders requiring separate commercial terms
  • Delivery to non-serviceable pincodes or restricted regions

Payment

We accept payments through authorized gateways supporting UPI, debit and credit cards, net banking, popular wallets, EMI, and Cash on Delivery (COD), subject to availability for your pincode and order value.

  • You represent that the payment method used is lawfully yours and that you are authorized to use it.
  • For COD orders, we reserve the right to verify the order by phone or OTP before dispatch. Unverified COD orders may be cancelled.

Taxes

All applicable Goods and Services Tax (GST) is included in the displayed price and charged in compliance with the GST Act, 2017. A valid GST invoice will be issued for every order. For B2B orders requiring a registered GSTIN, please provide it at checkout. Corrections after invoicing are limited and may not be possible.

Shipping & Delivery
  • Estimated delivery timelines shown on product or checkout pages are indicative only and not binding.
  • Delivery is fulfilled through third-party courier and logistics partners. Leeway shall not be liable for delays caused by couriers, weather, regional restrictions, strikes, natural disasters, or other events outside our reasonable control.
  • Risk and title in the Products pass to the Customer upon successful delivery at the shipping address.
  • It is the Customer's responsibility to ensure the shipping address is accurate and reachable. Re-shipping due to an incorrect address may attract additional charges.
  • Heavy or oversized fitness equipment may be delivered kerbside or to the building entrance only unless premium installation has been opted for separately.

Returns, Refunds & Replacements

All returns, refunds, replacements, and cancellations are governed by our Refund & Returns Policy, which forms an integral part of these Terms. By transacting with Leeway, you agree to be bound by that policy.

Promotional Codes, Coupons & Offers

From time to time, Leeway may offer discount codes, coupons, cashbacks, festival sales, or bundled offers. Such offers are:

  • Subject to the specific terms and dates mentioned with each offer.
  • Non-transferable, non-encashable, and non-stackable unless explicitly stated.
  • Valid only on prepaid orders, in some cases.
  • Subject to withdrawal, modification, or extension at Leeway's sole discretion without prior notice.

Use of promotional codes through manipulation, exploitation of technical errors, or in violation of the offer terms will result in the cancellation of the order and suspension of the account.

Intellectual Property Rights

All Content on the Website including but not limited to the Leeway brand names, logos, product designs, packaging, photographs, videos, illustrations, copywriting, A+ content, infographics, code, layout, and trademarks (registered and unregistered) is the exclusive property of Lavanya Teleservices Private Limited or its licensors, and is protected under the Trade Marks Act, 1999, the Copyright Act, 1957, and the Designs Act, 2000.

You are granted a limited, revocable, non-transferable license to access and view the Content for personal, non-commercial use only. You may not:

  • Reproduce, copy, distribute, transmit, modify, or create derivative works.
  • Use any Leeway trademark, logo, or brand asset without our prior written consent.
  • Frame, deep-link, or mirror any part of the Website.
  • Scrape or extract listings, images, descriptions, or pricing for use on third-party platforms.

Any unauthorized use will be prosecuted to the fullest extent of Indian and applicable international IP law.

User-Submitted Content (Reviews, Photos, Videos)

When you submit reviews, ratings, comments, photos, videos, or other materials ("User Content") to the Website or to Leeway's social channels:

  • You grant Leeway a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the User Content in any media and for any lawful commercial or promotional purpose.

Specific manufacturer warranties for Products are separate and governed by the warranty card supplied with each product.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Leeway, its directors, officers, employees, affiliates, agents, suppliers, or licensors be liable for any:

  • Indirect, incidental, special, consequential, exemplary, or punitive damages
  • Loss of profits, revenue, business, goodwill, data, or anticipated savings
  • Personal injury, illness, or death arising from the use or misuse of fitness equipment (see Section 4)
  • Damage to property arising from improper assembly, installation, or use of Products

Leeway's aggregate liability for any claim arising out of or relating to these Terms, the Website, or any Product shall in no event exceed the amount actually paid by you for the specific Product giving rise to the claim, or ₹10,000, whichever is lower.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such cases, our liability shall be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Lavanya Teleservices Private Limited, its directors, officers, employees, affiliates, and partners from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your breach of these Terms or any applicable policy
  • Your violation of any law or third-party right
  • Your misuse of the Website or any Product
  • Any User Content submitted by you
  • Your negligence or wilful misconduct

Force Majeure

Leeway shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, floods, earthquakes, pandemics, epidemics, government actions, lockdowns, strikes, civil unrest, war, terrorism, fire, internet or power failures, courier disruptions, or any other force majeure event. The performance of obligations shall be suspended for the duration of such event.

Suspension & Termination

Leeway reserves the right, at its sole discretion and without prior notice, to:

  • Suspend or terminate your access to the Website or your account
  • Cancel pending orders
  • Refuse future service

If we reasonably believe you have breached these Terms, engaged in fraud or abuse, or pose a security or legal risk. Termination shall not affect any rights or obligations that have accrued prior to termination, and Sections 4, 11, 16, 17, 18, 21, and 22 shall survive termination.

Governing Law, Jurisdiction & Grievance Redressal

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.

Dispute Resolution

In the event of any dispute, claim, or controversy arising out of these Terms or your use of the Website:

  • The parties shall first attempt to resolve the dispute amicably through good-faith negotiation by contacting our Grievance Officer (Section 21.3).
  • If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the competent courts at Meerut, Uttar Pradesh, India.

Grievances will be acknowledged within 48 hours and resolved within 30 days of receipt, as mandated by law.

General Provisions

Severability: If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: No failure or delay by Leeway in exercising any right under these Terms shall operate as a waiver of that right.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Leeway may assign these Terms freely to any affiliate or successor entity.

Entire Agreement: These Terms, together with the Refund & Returns Policy and Privacy Policy, constitute the entire agreement between you and Leeway concerning the subject matter herein and supersede all prior or contemporaneous communications.

Headings: Section headings are for convenience only and shall not affect interpretation.

No Agency: Nothing in these Terms creates any partnership, agency, joint venture, or employment relationship between you and Leeway.

Survival: Provisions that by their nature should survive termination, including IP, disclaimers, limitations of liability, indemnification, and dispute resolution, shall survive.

Changes to These Terms

Leeway reserves the right to modify, update, or replace these Terms at any time at its sole discretion. Material changes will be notified by:

  • Updating the "Last Updated" date at the top of this page
  • Posting a notice on the Website homepage, or
  • Sending an email to registered users

Your continued use of the Website after any change constitutes acceptance of the updated Terms. If you do not agree with any update, you must stop using the Website.
